Background

For ten years, plaintiff Robert Burck has been better known as “The Naked Cowboy,” a street performer in New York City’s Times Square identified by his attire… or lack thereof: a white cowboy hat, cowboy boots, white underpants and an acoustic guitar emblazoned with “The Naked Cowboy.” The Naked Cowboy has reached iconic status in New York City – he has become a tourist attraction and has made appearances in numerous films and tv shows.

Burck registered trademarks relating to The Naked Cowboy’s name and likeness, and has licensed that name and likeness to companies for endorsements and advertisements.

Defendant Mars is the famous candy company that makes, among other products, M&M’s. Mars and its advertising agency created electronic billboards in Times Square and a related mural for its M&M World store in Times Square. In both the billboards and the mural, M&M candies were pictured in an M&M version of New York City – as the Statue of Liberty, riding a carriage in Central Park, as King Kong climbing the Empire State Building, and yes… as the Naked Cowboy. Specifically, a blue M&M was depicted wearing a white cowboy hat, cowboy boots, white underwear and carrying a guitar, standing in front of a backdrop that looked a lot like Times Square. It was undisputed that Mars did not request or receive Burck’s permission related to the billboards or mural.

Burck filed suit against Mars in February 2008, alleging two causes of action: 1) violation of New York State’s right of privacy/ right of publicity law (N.Y. Civil Rights Law section 51), and 2) trademark infringement under section 1125(a) of the Lanham Act, 15 USC section 1125(a).

The defendants filed motions to dismiss and Burck filed a motion to strike some of the defendants’ asserted affirmative defenses, namely fair use, the First Amendment and parody. On June 23, 2008, the district court for the Southern District of New York denied Burck’s motion and denied in part/ granted in part the defendants’ motion. Ultimately, the court determined that Burck’s trademark infringement claim may proceed as alleged. Burck v. Mars, Inc., ___ F. Supp. 2d ___, 2008 WL 2485524, No. 08 Civ. 1330 (DC), (S.D.N.Y. 2008).

Mars did not violate Burck’s right to privacy/publicity

The district court first considered whether the defendants had violated Burck’s right to privacy/ publicity under New York State law; the court determined that they had not.

“In order to maintain an action under [N.Y. Civil Rights Law] section 51, a plaintiff must show that the defendant (1) used his name, portrait, picture, or voice, (2) for advertising or trade purposes, (3) without his written consent.” 2008 WL 2485524, *3.

In this case, the second and third elements were not in dispute – the only question was whether Mars actually used Burck’s portrait or picture, which could include “any recognizable likeness” of Burck and “any representation” of him. 2008 WL 2485524, *4 (citing Allen v. Nat’l Video, 610 F. Supp. 612, 622 (SDNY 1985), and Young v. Greneker Studios Inc., 175 Misc. 1027, 1028 (N.Y. Sup. Ct. 1941)). At the same time, however, a use that merely evokes certain aspects of another’s personality or suggests certain characteristics of another without literally using their picture or portrait is not actionable under the New York statute. 2008 WL 2485524, *4.

The court determined that Mars did not violated the statute for reasons. First, the M&M cowboy is clearly not a portrait or picture of Burck himself. 2008 WL 2485524, *5. Second, Mars only evoked certain aspects of a character played by Burck and copied that character’s costume, which does not constitute actionable conduct. Id. The court specifically stated “the statutory right to privacy does not extend to fictitious characters adopted or created by celebrities.” Id.

The court likened the case to White v. Samsung Elecs. Am. Inc., 971 F.2d 1395 (9th Cir. 1992), in which Vanna White sued an electronics company for creating a robot that looked and acted like her. The White court rejected White’s statutory right to privacy claim, stating that the “caricature or impressionistic resemblance” was not a “likeness” within the meaning of the statute. Id. at 1397.

Burck argued that his “public persona” was the same thing as his portrait or picture under the statute, but the court rejected that argument, stating: “Here, there was no attempt to create a portrait or picture of Burck himself. Rather, the purportedly infringing images were M&M characters wearing Burck’s signature outfit.” 2008 WL 2485524, *7.

Mars’ images may violate the Lanham Act

Even as the court rejected Burck’s right to privacy/publicity claim, it stated that this type of claim – copying a trademarked look – is more appropriately brought as a Lanham Act violation.

Specifically, Burck claimed that Mars’ use of his trademarked image falsely suggested that Burck endorsed M&Ms; the court agreed that this was a real possibility. The elements of false endorsement under the Lanham Act are that the defendant: (1) in commerce, (2) made a false or misleading representation of fact, (3) in connection with goods or services, (4) that is likely to cause consumer confusion as to the origina, sponsorship, or approval of the goods or services. 2008 WL 2485524, *7. (citations omitted). Again, the first three elements were undisputed – the real question was the likelihood of consumer confusion.

Mars contended that its images were mere parodies of Burck, which could not cause consumer confusion. The court noted that a claim of parody had dual uses in trademark infringement cases – to negate the fourth element of the cause of action, and as an affirmative defense of fair use. 2008 WL 2485524, *7 – 8.

Mars claimed that its images “conjure[d] up just enough of Burck’s trademark” for consumers to get the obvious joke. But the court held that whether or not consumers would see the M&M images as a parody or not is a question of fact for the ultimate trier of fact to decide, not a question of law to be adjudged on a dispositive motion. 2008 WL 2485524, *8.  The court pointed out that some consumers may get the alleged joke, while others may mistakenly believe that Burck had endorsed the images because of their commercial setting. Id. The factfinder must determine whether the claimed parody was strong enough to negate the potential for consumer confusion. Id. As a result, the court allowed Burck’s false endorsement claim to go forward.

The parody, fair use and First Amendment defenses remain

Burck moved to strike these affirmative defenses on two grounds: 1) the video and the mural were not parodies at all, and 2) even if they were parodies, that defense does not apply to parodies that advertise a product. 2008 WL 2485524, *9.  As to the first defense, the court reiterated its finding that whether or not the images constitute successful parodies is a question of fact, not one that should be resolved in an early dispositive motion.

As to the second claim, the court acknowledged that while the parody defense does not apply to strictly commercial uses, many such uses are “hybrid” uses – part artistic expression and part commercial promotion. 2008 WL 2485524, *9. In such cases, the Second Circuit had developed a balancing test: “trademark protection is afforded ‘only where the public interest in avoiding consumer confusion outweighs the public interest in free expression.’” 2008 WL 2485524, *10. (citing Rogers v. Grimaldi, 875 F.2d 994, 999 (2nd Cir. 1989).

Here, Mars contended that its billboards and mural were artistic/commercial hybrids. The court agreed, finding sufficient evidence to allow defendants to plead the defense of parody and its related defenses of fair use and First Amendment. 2008 WL 2485524, *10.

Women seem to be more rationally driven when playing poker than most players of the opposite sex.

According to several sources, rational female poker players not only have to find ways of coping with the persistent sexism portrayed on the felt, but also to develop their unique poker strategy using their most obvious strengths. Some of the stereotypes that label reason-driven women are: the manipulative savvy, the classy-aggressive lady, and the bold aggressive go-getter.

The Manipulative Savvy. According to several sources, this category is where all deceiving appearances fall: the â??innocent girlâ? look, the â??bimboâ? look and the â??average brainless middle-aged housewifeâ? look. Women who can easily be judged by how they carry themselves are actually playing poker before sitting at the table; they are already bluffing about how they will potentially play. They know that by playing a seemingly weak female role, they are provoking the type of reaction from other players that will help them win the game: most of their opponents will not feel threatened by them; instead, they will more than likely try to show off their skills with the kind of confidence that really backfires when they realize the deceiving female savvy is taking all their money.

The bimbo will really use her sexuality to distract and irritate; the innocent girl will attract protection from gentlemen and frustration from girl-haters, and the middle-aged housewife will use her apparent ignorance and random curiosity for poker to her advantage.

Savvy women who fool others with their appearance can really benefit from this first impression, since it is easy to figure out a pattern of responses from sexist males to build a killing strategy at the table.

The Classy-Aggressive Lady. This type of female poker player can knock you off your feet when you least expect it. Far from falling into deceiving looks, she has her unique look and class that makes others respect her, but when it comes down to getting everybodyâ??s money, she is relentless.

No emotions or time for drama. She usually has a serious face and keeps to herself, and calmly tolerates sexism with an indifferent attitude, giving energy only to the game. Of course, when it is time to show what sheâ??s made of, she enjoys her victories with a reserved smile.

The previous personality descriptions sound more rational than emotional, and it seems like women have learned to protect themselves from poker sexism with exactly the opposite of what is expected of them: getting rid of emotional responses at the table.

This has apparently spurred a highly emotional response from their male opponents, to the point of switching labels from the famous book Men are from Mars, Women are from Venus. Player and author Steve Badger states that â??women as a group play poker more successfully than men do because they lose less per capita than men. The mass of women players — most playing tightish, non-hormonal poker — do far better than the mass of men, a great many of whom let ego, machismo and testosterone affect their play dramatically.â?

Women would prefer men to find out and discover what it is they actually want. Men though cannot understand why women suddenly give them the silent treatment without them knowing the exact reason. Women should tell their men outright their reasons for being angry or disappointed or what it is they exactly want instead of keeping them guessing. Men should also understand that women are very emotional beings who want them to be in touch with their emotional side, trying to show that they care and they understand. Women who are angry just need your consolation and your show of remorse.
Women love to talk but they have to understand that there are times when men just want to relish in the silence to clear their minds. When women talk and their men seem not to be listening, they assume that their men don’t give a care or concern. Actually, they do. It is just that there are really times when they want to take a break from women’s chatter. Give them space. If you want to engage in an intimate moment like some sweet talk when in bed, get into some action instead.
Men look at problems in a different matter. While women talk out their problems to their partners and friends to vent out feelings and to receive advice or consolation, men on the other hand don’t wallow in the situation for a while and instead look for options and solutions that could address their concerns.
You can’t expect men to be verbal about their emotions and feelings unlike women. Many may not verbally say “I love you” or “I’m sorry” but they do try to make it up to the women they love in other ways.

Sex is not foreplay unless you want to. Sex is not only about sex. To most people, sex is ‘making love’. They are sharing their body and emotions to someone they love most. If people have sex just to get some and to release stress, then what is love for?

I know people are responsible for their own actions. They have the right to make a choice to have sex or not, but I can’t change the way they think about sex. People love having sex because it brings out excitement and pleasure. People love having sex to satisfy their partner. People love having sex at the heat of the moment. That is not love, period.

Another reason I want to mention is people have sex just to rank up their count and experience. I advise men and women not to do this because it will haunt you later on in life. What happens if you’re on your date and they ask you how many times you have sex, and how many people? What are you going to say? 6? 10?

To men, if you’re on a date and they say 7, what are you going to think? Is this too much for a woman? Of course, women have it much harder than men do in today’s society.

To women, if you’re on a date and they say 15, what are you going to think? That this guy is no use to me and he will just run away if we have sex?

My point is, sex should be based on whether you want to share it with someone you are in love with. People should be protective and must choose their actions correctly. If sex is about having sex and nothing more than that, then reconsider your actions. When Venus and mars meet, anything is possible. Being in love is possible.

The luxury hotel has a jaw-dropping view of the Atlantic Ocean and houses two prominent restaurants.

You can of course, eat in at any one of them but for breakfast we strongly recommend one of the restaurants by the sea, restaurants like La Martini which has a deck. Munching spaghetti balls or gnocchi dipped in cheese or white sauce with fresh orange juice while feeling the breeze rush through your hair is an experience you will never forget. Thereâ??s plenty to do in the city. You can go shopping, for instance, at the Diagonal Puerrydon for exotic Argentinean handcraft including tango figurines, trinkets, and candle-holders. For day-to-day or electronicsâ?? shopping you could visit the shopping mall at Los Gallegos. We might as well mention that the city is also famous for its sophisticated range of electronicsâ?? goods among other things. But if you find the shopping activity too mundane why not go down to the sea and try some recreational angling? For those who might be unaware, Argentina offers some of the worldâ??s best fishing spots. And if you are a keen golfer you should check into any one the five vast and scenic golf courses that will allow you to indulge in your favorite sport if you are willing pay, that is.As evening approaches you might want to throw caution to the winds in this big bold city and while away your time â?? and money â?? at yet another of its attractions- Casino Central Mar del Plata with its close 140 game tables and 565 slots. The maddening swirl of the city with its epicenter of calm can leave you quite breathless!
